Arbitration

Binding arbitration is a method of dispute resolution that involves an attorney acting as judge in her office at a conference table. Witnesses testify under oath. This allows a hearing, or trial, on consecutive days, rather than spread out over weeks or months as in court. Thus, repeated costly preparation for intermittent days of trial is reduced or eliminated. The parties and Arbitrator schedule trial at the convenience of the parties and witnesses.

The New Jersey Statutes, N.J.S.A. 2A:23B-1, et seq, allow Arbitration of all Family Law matters, including custody and parenting time. Parties frequently choose to arbitrate when trial in court might subject them to penalties in connection with tax issues. The parties can choose whether or not to record the hearing, and what Evidence Rules and Court Rules shall apply.
